C-21 Repealing 'Indian Clause' of Canadian Human Rights Act

Summary

This bill takes out 'section 67' of the Human Rights Act. The text to be removed from the Canadian Human Rights Act reads "Nothing in this Act affects any provision of the Indian Act or any provision made under or pursuant to that Act."

This bill removes that clause and provides for a re-examination of its effect in five years.

Bill History

This bill (originally C-44 from the last session of parliament) was re-introduced on November 13th, 2007. It was deemed read a second time and sent to committee. The committee sent back a few changes in wording, and suggested that the five-year review be "jointly undertaken by the Government of Canada and any organizations identified by the Minister of Indian Affairs and Northern Development as being, in the aggregate, representative of the interests of First Nations peoples throughout Canada."
